WARNING, WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT
Duality Arms Co., LLC (“Company”) — READ CAREFULLY. BY CHECKING “I AGREE,” YOU ARE ACCEPTING LEGAL RESPONSIBILITY AND ASSUMING CERTAIN RISKS.
1. Parties; Scope
1.1 This Agreement is between Duality Arms Co., LLC, a Texas limited liability company (“Company,” “we,” or “us”), and the purchaser or user of our products (“Customer,” “you”).
1.2 This Agreement applies to all current and future products offered by the Company and to all activities related to their purchase, installation, possession, transport, storage, and use.
2. Product Safety Acknowledgment
2.1 You acknowledge that the Company’s products relate to the operation and mechanical function of firearms, which are inherently dangerous instruments capable of causing serious injury or death if handled improperly.
2.2 The Company provides video-guided installation instructions to assist with proper setup. You agree to follow all video instructions carefully, as well as any safety guidance provided by your firearm manufacturer.
2.3 Product Use Warning:
(a) You must fully understand how the firearm operates before and after installation of any Company product.
(b) These products should only be used by individuals who are familiar with safe firearm handling and operation.
(c) Improper understanding or installation of the product may result in unsafe conditions, unintentional discharge, or serious injury.
(d)Always practice safe handling procedures, maintain muzzle awareness, and use appropriate protective gear (eye and ear protection) during installation, function checks, and live-fire testing.
3. Eligibility
3.1 You affirm that you are at least 18 years old and not prohibited under any federal, state, or local law from purchasing or possessing firearm parts or accessories.
3.2 You agree not to sell, transfer, or make available the Company’s products to any person who does not meet these eligibility requirements.
4. Assumption of Risk
4.1 You voluntarily and knowingly assume all risks associated with the purchase, installation, ownership, and use of the Company’s products.
5. Customer Responsibilities
5.1 Inspect the product upon delivery to confirm it is undamaged and complete before installation.
5.2 Only install products on compatible firearm platforms and only after fully reviewing the Company’s video installation guidance.
5.3 Use ammunition and firearms that comply with the manufacturer’s published specifications.
5.4 If you experience unusual or unsafe function, immediately stop using the product and contact Duality Arms Co. for troubleshooting assistance before using it again.
6. Release and Waiver of Liability
6.1 To the fullest extent permitted under Texas law, you hereby release, waive, and discharge Duality Arms Co., LLC, its owners, members, managers, employees, contractors, distributors, dealers, successors, and assigns (“Released Parties”) from any and all claims, demands, causes of action, damages, or losses arising out of or related to the product, including those caused in whole or in part by the ordinary negligence of any Released Party.
6.2 This release applies to all claims for personal injury, death, property damage, or any other losses resulting from your purchase, installation, use, or storage of the product.
6.3 This release does not, and is not intended to, waive any rights or claims that cannot legally be waived under applicable law.
7. Indemnification
7.1 You agree to defend, indemnify, and hold harmless the Released Parties from any third-party claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your misuse of the product, violation of this Agreement, or violation of any law.
8. Warranty and Legal Use
8.1 This waiver does not replace or remove any warranty the Company provides. The Company’s written Limited Lifetime Warranty remains in effect according to its own terms.
8.2 You agree to use all products only in a lawful manner and to comply with all federal, state, and local firearm regulations.
9. Transfer or Resale
9.1 If you sell, gift, or transfer a Company product to another person, you are responsible for ensuring that the recipient:
(a) is legally eligible to own and use firearm components, and
(b) has read and agrees to the terms of this Agreement.
If the recipient does not accept these terms, you may be held liable for any resulting consequences or damages.
10. Enforceability and Notice
10.1 If any part of this Agreement is found invalid or unenforceable, the remaining sections will continue to apply to the fullest extent allowed by law.
10.2 As part of Texas’s “Fair Notice” requirement, this Agreement clearly states that you are giving up your right to hold Duality Arms Co. responsible for accidents that might happen due to ordinary mistakes or negligence. However, this Agreement does not remove your right to bring a claim if the Company intentionally causes harm or acts with extreme recklessness.
11. Governing Law and Venue
11.1 This Agreement is governed by and interpreted under the laws of the State of Texas.
11.2 Any disputes or legal actions related to this Agreement must be brought exclusively in Coryell County, Texas.
11.3 All claims must be brought individually, not as part of a class action.
12. Acknowledgment and Acceptance
12.1 You acknowledge that you have read this Agreement, understand its contents, and understand that by checking “I AGREE,” you are waiving certain legal rights, including the right to sue for ordinary negligence.
12.2 If for any reason these terms are unacceptable to you, DO NOT PURCHASE OR USE THE PRODUCT.
13. Electronic Acceptance
13.1 By checking the “I AGREE” box or clicking a clearly labeled acceptance button prior to completing your purchase, you confirm that you have read, understood, and agreed to be bound by this Agreement under the Texas Uniform Electronic Transactions Act (UETA) and the federal ESIGN Act.
14. Effective Date and Updates
14.1 This Agreement represents the most current version of the Company’s Warning, Waiver, Release, and Assumption of Risk Agreement.
14.2 The Company may revise or update this Agreement at any time. Updates will be posted on the Company’s website, and your continued purchases signify your acceptance of the most recent version.
